This CLE webinar will guide counsel on structuring value-based contracts. The panel will discuss the key considerations for the parties when deciding whether to enter into a value-based contract and the risks and steps to mitigate those risks. The panel will also address key provisions in value-based contracts and offer best practices for structuring such arrangements.

Description

The healthcare industry is shifting to value-based contracting to control costs and improve patient outcomes. Payers are more interested in value-based contracts and manufacturers increasingly incorporate such contracts into their strategic plans.

Often value is equated with the price. However, price is not the only criterion for determining value. Other key considerations include transparency, access, choice, and predictability. Value-based contracts are complex and should address several specific issues, including Stark and Anti-kickback, the scope of unit price reductions, anti-steerage language, network tiers, dispute management and resolution, payer incentives, benefit incentives, data sharing, and termination.

Listen as our authoritative panel of healthcare attorneys examines the parties' key considerations when deciding whether to enter into a value-based contract. The panel will also examine the risks and what steps can be taken to mitigate those risks. The panel will also address key provisions in value-based contracts and offer best practices for structuring such arrangements.
