This CLE course will provide trademark owners and counsel with guidance on the advantages and disadvantages of using the USPTO’s Trademark Trial and Appeal Board’s (TTAB's) Accelerated Case Resolution (ACR) process to resolve trademark cases. The panel will provide strategies for trademark owners and their counsel for participating in ACR.


The TTAB's ACR gives trademark owners and their counsel a streamlined alternative for resolving cases. While a determination of the claims and defenses can be issued without a trial, an ACR also gives the TTAB an opportunity to resolve issues of fact.

The ACR process can save the litigating parties time, resources and costs. However, trademark owners and their counsel must carefully assess whether an ACR is right for them.

When evaluating whether to participate in an ACR, counsel to trademark owners must evaluate the complexity of the case, the volume of documents to be reviewed, and whether time is of the essence.
