This CLE webinar will guide healthcare attorneys on the resolution of physician partnership disputes. The panel will discuss potential conflicts and areas of dispute, including in the context of employment contracts and operating and other agreements. The panel will address conflict resolution and pre-litigation strategy and offer best practices for resolving physician partnership disputes.

Description

Physicians often form partnerships to start a medical practice but may fail to document the relationship adequately. Matters like compensation or profit sharing are generally covered, but partner withdrawal or removal issues are not. If the agreement is silent about the addition of new equity partners, disputes may arise over how the current partners' shares are impacted. That can easily result in litigation, which results in unnecessary expenses and can destroy a practice.

When disputes cannot be resolved internally, physicians can turn to formal conflict resolution. If conflict resolution strategies are unsuccessful, the partner can sue to resolve the conflict, or the partners can agree to dissolve the partnership and liquidate the assets. If dissolution results, physician partners then face unique considerations in transitioning their practice to a buyer, including medical records and patient notifications.

Listen as our authoritative panel of healthcare attorneys examines potential conflicts and areas of dispute. The panel will discuss dealing with potential conflicts in employment contracts and operating and other agreements. The panel will address conflict resolution and pre-litigation strategy and approach and offer best practices for resolving physician medical partnership disputes.
