This CLE course will prepare counsel to pharmaceutical and medical device companies to develop a risk management program geared toward avoiding product liability. The panel will explore ways to leverage a company's risk management measures in defending product liability suits.


Two essential concepts in risk management for pharmaceutical and medical device manufacturers are complianceavoiding violating laws and regulationsand preventionidentifying and mitigating potential risks. Counsel must incorporate these concepts into clients’ risk management plans.

While planning, designing and monitoring a product liability compliance program are crucial to effective risk management, adopting a compliance program alone does not fully protect from liability claims. Other risk management measures must be developed along with a compliance program to mitigate liability.

Counsel must also work with clients to develop training programs, review insurance coverage, screen contractors, manage contract liability, and work with the sales and marketing process.
