This CLE course will demonstrate to plaintiffs' and defendants' counsel the steps necessary to fortify a successful result (or avert that horrible defeat) while the case is in trial. Without taking proper measures at trial, victory will be fleeting. By examining recent reversals of multi-million dollar verdicts, the panel will provide valuable practice "musts."

Description

When the jury announces a multi-million dollar verdict, the trial lawyers on each side experience extreme emotions--the winner is elated; the other party, deflated. The decision is but one chapter in the narrative of the case that only ends after the appeal.

Although some reversed huge verdicts relate to points of substantive law, others do not. An appellate panel can seize upon counsel’s improper argument or other conduct to invalidate the result at trial. A trial court's failure to properly instruct a jury will doom a great outcome. And the size of the judgment itself can trigger a reversal. In each of these instances, a strategic decision or request that went too far could be the root cause.
