This CLE course will examine the legal issues confronting litigators when pursuing or defending claims against insurance companies. The panel will offer best practices for seeking or opposing class certification, bringing or challenging dispositive motions, and navigating the discovery process, as well as plaintiff and defense settlement strategies.

Description

Class action plaintiffs’ attorneys frequently pursue litigation against insurance companies on behalf of policyholders challenging the manner in which insurance products were sold and/or the way claims were handled. Property, title, auto, life and casualty insurance products have all been the subject of class action claims.

Recent changes to class certification standards and the standards for removal under the Class Action Fairness Act, as well as the customary and costly practice of counsel to make broad discovery requests, all affect plaintiff and defense strategies in insurance class actions.

Listen as our authoritative panel of class action plaintiff and defense attorneys discusses current trends and case law developments impacting insurance-related class actions. The panel will outline strategies for increasing the likelihood of success from both the plaintiff and defense perspective at class certification, when pursuing or opposing dispositive motions, and during discovery.
