This CLE webinar will discuss situations in which equity may step in and require insurers to provide coverage under the terms of the policy notwithstanding a breach or lapse of the policy. The panel will review the elements of these equitable doctrines and the circumstances in which they are most likely to succeed, discuss who has the burden of proof to demonstrate the equities, highlight what types of evidence counsel should present to have the best chance of success, and point out pitfalls to avoid.

Description

Insurance is a creature of contract between the insurance company and the policyholder. But if the insurer denies coverage because it asserts the policy was void or has been rescinded, it is often third parties that suffer unjustly. Most jurisdictions recognize an innocent co-insured/innocent injured doctrine and will require the insurer to provide coverage after balancing a number of competing equities. The burden of proof may be on the insurer or the insured.

In other situations, the notice-prejudice rule may offer relief after late-reported claims. Coverage under claims made policies may sometimes be found, for example, if a claim arises shortly before the end of an expiring policy but is not reported until shortly after the renewal. Equitable reformation allows courts to enforce the contract as intended despite some variation in the written policy and may refuse to excuse coverage if the policy's endorsements are ambiguous and contradictory.

Equitable subrogation may allow an excess carrier to recoup its payment from the primary by putting it into the shoes of the insured.
