This CLE webinar will guide IP and brand counsel on the WHOIS system and brand protection after the EU General Data Protection Regulation (GDPR). The panel will examine the impact of the GDPR and offer best practices on protecting brands during this period of uncertainty.

The EU General Data Protection Regulation (GDPR), which went into effect in May 2018, expanded the circumstances in which EU data protection law applies to companies outside the EU and subjects organizations that do business in the EU or transfer personal data outside of the EU to increased responsibilities and obligations concerning privacy and data protection.

The Internet Corporation for Assigned Names and Numbers (ICANN) requires domain name registrars and registry operators to collect and publish domain name registration information in the publicly accessible WHOIS database. Brand owners and others who use WHOIS to identify malicious domains and research infringement claims are now hampered in their efforts to protect their IP rights on the internet.

ICANN has an interim system, but IP owners have limited access to useful data. IP owners and their counsel must navigate the domain name landscape with the GDPR in place and find ways to police and protect IP rights.

Listen as our authoritative panel examines the impact of the GDPR on brand protection and what IP owners and counsel can do now that GDPR is in place. The program will discuss the impact of the GDPR on the WHOIS system and the Temporary Specification. The panel will offer guidance for brand owners/counsel on policing their trademarks online and protecting their brands during this period of uncertainty.

  1. Impact of the GDPR on brand protection
  2. WHOIS system and the Temporary Specification post-GDPR
  3. Best practices for protecting their brands post-GDPR

The panel will review these and other high profile issues:

  • What are the consequences of the implementation of GDPR on WHOIS?
  • What changes has ICANN made to the WHOIS system in light of GDPR?
  • What alternatives do IP owners have for investigating malicious domains and infringers?
