Description

The explosive growth of the telecommunications marketplace and need for high speed communications has created a demand for leasing space on building rooftops. Cell site leases are very long in duration so owners must understand the impact of long-range redevelopment of the property.

Landlord concerns include the location of the equipment on the roof, description of the equipment, installation and removal, and the risk that the lessee will seek early termination of the lease. Cell tower lessees are most concerned about their rights to terminate the rooftop lease for reasons such as loss of operating licenses or technological developments negatively impacting the structure’s usefulness.

Most leases are drafted by the cell phone carrier and hence are very slanted toward the tenant. While roof top telecom leases can be very profitable, there are pitfalls inherent in these leases that counsel for landlords and owners must consider in the negotiating process.
