This CLE webinar will provide employee benefits attorneys guidance on current rules and requirements for plan disclosures, notices, and elections. The panel will discuss disclosures and reporting requirements for ERISA plans, critical issues for health and welfare plans, use of electronic media, recent DOL guidance, and other essential items to ensure compliance.

ERISA and the Internal Revenue Code (IRC) place numerous disclosure, notice, and election requirements for employee benefit plans. This year, the DOL and IRS issued several regulations and additional guidance due to the pandemic. Employee benefits counsel and plan administrators must recognize key issues relating to required disclosures, notices, and elections and implement methods to ensure compliance.

The DOL and IRS have issued joint notices and guidance for plan administrators throughout 2020, providing relief for deadlines and other areas impacting employee benefit plans. As the country looks forward to some normalcy, plan administrators need to review their practices and avoid missteps for distributing plan disclosures and notices and for obtaining elections. Any failure to adhere to compliance requirements can result in significant penalties.

Listen as our panel of experienced ERISA practitioners examines recent regulations and guidance impacting employee benefit plans. The panel will give special attention to strategies for ensuring compliance with plan disclosures, notices, and elections under ERISA and IRC. The panel will also offer drafting techniques for plan documents that comply with ERISA and DOL requirements while avoiding potential challenges from plan participants.

  • What guidance and safe harbors have been provided by the DOL?
