This CLE webinar will provide guidance to employment law counsel for understanding and managing complex legal and practical challenges that arise when employees engage in politically motivated speech and conduct in and out of the workplace. The panel will discuss the federal and state laws implicated and best practices for employers to ensure legal compliance when addressing discipline, leave, protected concerted activity and related legal issues.

Description

In the wake of a contentious presidential election, employee participation in political conversation, protests and mass labor strikes has surged, creating a number of tough questions for employers.

Employers are grappling with whether they can legally discipline employees for skipping work in support of a mass strike, whether they are required to approve leave requests for employees participating in political protests, how to address employee use of social media to express political opinions, and other related issues.

Employment counsel guiding employers must be familiar with the federal laws and state statutes protecting employees from discrimination, retaliation, political coercion or intimidation, as well as the rights of employees to engage in protected concerted activity under the National Labor Relations Act.

Counsel must also be prepared to advise employers on exempt employees’ rights to compensation under the Fair Labor Standards Act (FLSA) for taking time off to participate in political activities.
