Certain physician-owned entities in the medical device space, more commonly referred to as physician-owned distributors (PODs), possess characteristics that the Office of the Inspector General (OIG) has identified as “inherently suspect” under the Anti-Kickback Law.

In light of OIG guidance, regulators have placed increased scrutiny on PODs and hospitals have taken steps to limit their dealings with the riskiest of these entities.
