This CLE webinar will provide environmental counsel with an overview of the recent science related to per- and polyfluoroalkyl substances (PFAS), recent precedent-setting cases and recently enacted legislation that will impact PFAS regulation and liability, and focus on the rapidly developing state regulatory environment and its impact on clients across industries.

Description

PFAS have made headlines recently as state regulators have begun implementing strict new regulations of the chemicals as PFAS continue to be found in drinking water supplies across the country. PFAS includes a class of per- and polyfluoroalkyl chemicals used in firefighting foams, food packaging, stain- and water-repellent fabrics, dental floss, nonstick cookware, and many other consumer products.

EPA recently released a long-term action plan for PFAS, and states have issued new health advisories, groundwater cleanup standards, and sampling requirements.

The new PFAS regulation arrives at the same time as a growing trend in toxic tort litigation involving emerging contaminants. PFAS regulation and toxic tort litigation is challenging accepted notions of risk-based science as environmental advocates push for ever stricter regulations of emerging contaminants and plaintiffs have been successful in toxic tort litigation involving PFAS, glyphosate, and other chemicals in consumer products.
