This CLE webinar will guide personal injury attorneys in navigating the complex liability and insurance coverage issues that arise from auto accidents involving rideshare services such as Uber and Lyft. The panel will discuss the plaintiff and defense perspectives on this emerging area of the law.

Uber and Lyft rideshare services continue to grow at a rapid pace. Uber currently operates in 633 cities in the U.S. and worldwide; recent reports value the company at $72 billion. Lyft's estimated value is $15.1 billion; it serves about 300 U.S. and Canadian cities.

As rideshare services continue to expand, auto collisions involving rideshare drivers have spiked. Drivers must simultaneously drive and use smartphone apps for directions and customer information while navigating frequently unfamiliar areas, all of which increase the likelihood of accidents. The webinar will provide information about potential avenues for recovery, and updates on related case law. In addition to the now traditional ride share scenarios, delivery services and automated ride services have entered the marketplace.

Passengers, pedestrians and drivers injured in an auto accident caused by a rideshare driver may pursue compensation for their injuries from various sources, including the driver’s personal insurance, the rideshare company’s insurance, and potentially other applicable sources.

Personal injury claims involving rideshare services present unique liability and insurance issues because the companies typically treat their drivers as independent contractors instead of employees. Uber calls itself an e-commerce platform rather than a transportation company (though a court in the EU ruled otherwise).

Listen as our panel of plaintiff and defense counsel examines the unique issues attorneys face in bringing or defending against claims for injuries sustained in accidents caused by rideshare drivers. The panel will discuss how to prove or challenge liability and unravel insurance coverage complexities under current and emerging constructs.

  1. Overview of rideshare companies' policies on auto collisions
  2. Bringing or defending personal injury claims for accidents involving ridesharing services
    1. Liability considerations
    2. Insurance considerations

Our panel will review these and other critical issues:

  • How rideshare service company policies deal with auto collisions involving its drivers
  • Liability considerations in rideshare services' accident injury claims
  • How courts are addressing insurance coverage issues in rideshare injury cases
  • Emerging issues such as delivery services and a possible return of automated services
