This CLE course will provide litigators with key techniques for selecting jurors. The panel will offer specific tips for using social media, strategic questioning, identifying juror bias, dealing with tainted jury panels, and avoiding common mistakes during voir dire.

Effective jury selection is one of the key aspects in the outcome of trials in commercial litigation and can be extremely difficult. Voir dire gives attorneys an opportunity to size up the individuals responsible for deciding their clients’ fate.

Skilled litigators understand and practice the art of eliciting and recognizing biases in potential jury members. Counsel must quickly and strategically respond within the confines of rules of civil procedure upon detecting such bias.

Our experienced panel will offer guidance on utilizing new resources of information on jurors, such as social media. Social media is proving to be a powerful tool in selecting optimal jurors. Counsel must also be adept at responding quickly to instances of tainted jury panels.

Listen as our authoritative panel discusses key techniques in conducting effective voir dire to include strategic use of peremptory and “for cause” strikes, eliciting and determining biases that may affect the outcome of the case, and effectively handling tainted panels within the confines of rules of procedure.

  1. Effective questioning
  2. Use of social media as part of jury selection
  3. Determining bias
  4. Effective use of preemptory and “for cause” strikes
  5. Dealing with a tainted jury panel

The panel will review these and other key questions:

  • What techniques can litigators use to increase the “likeability” of their client by potential jurors during jury selection?
  • What types of open-ended questions are likely to indicate the biases of potential jurors?
  • How can litigators precondition jurors to the key themes in their case during voir dire?
  • How can litigators utilize social media to their benefit in optimizing jury selection?
  • How must litigators quickly and efficiently handle a tainted jury panel?

Following the speaker presentations, you'll have an opportunity to get answers to your specific questions during the interactive Q&A.
