This CLE webinar will offer guidance to environmental lawyers and general counsel for chemical companies on navigating recent amendments to the Toxic Substances Control Act (TSCA). The panel will discuss the process outlined in Section 5 of the TSCA, addressing challenges in the premanufacture notices, compliance and enforcement, and prospective trends in EPA determinations.


The 2016 amendments to section 5 of the Toxic Substances Control Act made important changes to how EPA reviews new chemical substances and subsequent actions. These changes affect whether EPA quickly reviews a premanufacture notice (PMN) or instead takes a year or longer to review it. They also affect whether EPA will issue an order for the new chemical substance, and whether it will adopt a significant new use rule (SNUR) for it. Now that we are over two years into implementation of the amendments, this webinar will clarify with respect to new chemical substances the statutory changes, the policy changes, the actual practices, and what may be in store. It will also suggest ways in which companies can maximize their chances of a good outcome for their PMNs.
