Annexation is a subject of controversy and contention in municipalities throughout the nation. Less frequently, property owners pursue voluntary annexation to take advantage of a municipality’s services, such as utilities, police, fire and road maintenance.

Municipalities must follow strict statutory and procedural requirements for annexation, including providing affected citizens with adequate notice and the opportunity to participate in the process. Municipalities and their advisers must fully comprehend the complex taxation, land use and permitting challenges associated with annexation.

Before annexation officially begins, counsel for municipalities and landowners typically enter an annexation agreement outlining the terms and conditions of the annexation and the rights and obligations of each party.
