Cross-border mergers involving the US and European Union have seen rapid growth in the past few years, challenging counsel to meet antitrust standards for both. With both the US and EU reviewing the same transaction, applying similar laws, and seeking much of the same information, streamlining the process will save time and money.

Moreover, despite similar legal standards, counsel must understand the differences in philosophy, politics and economy between the US and EU that can result in very different outcomes.

The Microsoft Antitrust Litigation is a striking example of those differences - the US reached a settlement with Microsoft, while the EU imposed severe fines and required significant changes in its operating software and business operations in Europe.

Listen as our panel of global antitrust law specialists examine the issues that companies - and their counsel - face when seeking antitrust clearance for mergers from the US and the EU. The panel will focus on similarities and differences in the two systems and how to achieve filing efficiencies to save time and money.

The panel will review these and other key questions:

  • What are the differences between the US and EU in managing common clearance issues in mergers, such as market definition, unilateral effects and the like?
  • How can counsel achieve filing efficiencies to save time and money in producing the information needed for both the US and EU approval procedures?
  • What are the most effective strategies to "get the deal done" in coordinating overlapping investigations between antitrust agencies in the US and Europe?
