This CLE course will provide guidance to trademark counsel on the benefits and risks of registering marks on the Trademark Clearinghouse (TMCH) and ICANN’s new protection mechanisms. The panel will offer strategies for determining which marks to register and for defensive registrations.


In 2013, ICANN unveiled the TMCH, which serves as a repository for trademark data and provides a tool for companies and individuals to protect their trademarks. TMCH plays a key role in ICANN’s rights protection mechanisms.

Registration with the TMCH allows mark owners to take part in sunrise registrations and receive notification when others try to register names that include their marks registered with the clearinghouse. This enables owners to take preemptive action.

As the Internet domain name system expands, trademark owners face a new landscape for potential infringement. Counsel to IP owners must take steps now to protect brands.
