This CLE webinar will provide participants with an analysis of the current trends and developments in insurance coverage for data breaches and other serious privacy, cybersecurity and data protection-related incidents. Our panel of experts will discuss the recent trends in privacy and cybersecurity-related claims, litigation, and regulatory developments. Against the legal and regulatory background, our panel of experts will analyze potential insurance coverage for privacy and cybersecurity-related risks and exposures, including under “cyber” insurance and other potentially applicable insurance policies. Our panel of experts will also share with participants tips for placing appropriate coverage, and for maximizing coverage in a claims setting.

Description

Amidst a seemingly endless stream of data breaches and other serious cybersecurity and data privacy and protection-related incidents, many organizations find it prudent to purchase “cyber” insurance, which can play a vital role in an organization’s overall strategy to address, mitigate, and maximize protection against data breaches and other serious privacy and cybersecurity-related risks and exposures.

When purchasing “cyber” insurance, it is important for organizations to understand what the insurance does and does not cover, to be aware that the terms and conditions of these policies vary dramatically from policy to policy, and to carefully review and negotiate the terms and conditions as practicable and appropriate to make sure that the insurance addresses the specific risks faced by the organization.

Coverage for data privacy and cybersecurity-related incidents may also be available under other types of insurance policies, including management liability, directors and officers liability, errors and omissions, professional liability, commercial crime, fidelity, kidnap and ransom, and other types of insurance policies.

Listen as our panel of experts shares with participants their insights on a developing body of case law that has emerged in recent years regarding insurance coverage for data privacy and cybersecurity-related risks. The panel will review defense and plaintiff approaches to resolving coverage disputes that typically arise between an insurer and insured in the wake of privacy and cybersecurity-related incidents and provide an update on the case law that has emerged.
