The CLE course will analyze the Supreme Court's decision on the healthcare reform law and assess its impact for healthcare providers and others in the healthcare industry.


The U.S. Supreme Court, in its long-awaited decision, left in place the basic provisions of the Patient Protection and Affordable Care Act (ACA).

In its 5-4 decision, the Court upheld the individual mandate. The court concluded that while the individual mandate is unconstitutional under the Commerce Clause, the penalty is constitutional as a tax and is within Congress' power to tax.

The Court also held Congress is not precluded from offering Medicaid funds to states under the ACA to expand the availability of healthcare and requiring that states accepting such funds comply with the conditions. However, Congress cannot penalize states that do not participate by taking away existing funding.
