This CLE webinar will examine the applicability of the Daubert standard for expert evidence in hydraulic fracturing (fracking) disputes. The panel will analyze what is required to successfully present or defend a Daubert challenge to the admission of expert testimony.

Description

In the vast majority of fracking suits, experts are relied upon to provide opinions and testimony in support of claims of liability and damages. Such expert testimony often involves determining fault for groundwater contamination.

The Daubert decision and the body of law surrounding challenges to expert opinions and testimony continue to evolve for fracking disputes. Courts require expert testimony—as well as the methodology or technique on which it is based—be tested to ensure that it is relevant and reliable.

Environmental litigators and counsel involved in fracking disputes must be prepared to challenge or defend expert witness testimony. Expert witness challenges in groundwater contamination cases provides valuable guidance for litigators.
