This CLE webinar will address the broad array of legal issues relating to one of the fastest growing business areas today: food trucks. These restaurants-on-wheels raise issues ranging from zoning to licensing to tort claims, many of which are working their way through the courts right now.

Food trucks are one of the fastest growing segments of the restaurant business, with revenues jumping from $650 million to $2.7 billion over the most recently measured five-year period. The industry's growth has amplified the gaps and inconsistencies in zoning, speech, injury, employment and food safety issues regarding food trucks.

The highest profile legal attention to food trucks has concerned the right of food truck owners and operators to pursue their trade. Courts in Florida, Maryland and Illinois have ruled, or have recently taken on, cases that address these issues that pit a municipality's interest in land use and safety against interests relating to free speech and economic self-determination.

A plethora of practical matters follow these trucks everywhere they go. Local health agencies inspect food service establishments, but do they need to inspect each location they park? Is the local government in control of locations that food trucks park and therefore exposed to liabilities? Given that awards or settlements in food truck injury cases have reached into the millions of dollars, this is a pressing concern.

Join our diverse panel of speakers as they address these issues that are just now hitting the radar screens of municipalities around the country.

  1. Industry background
  2. Challenges to scope of regulation and zoning based on economic and other rights
  3. Licensing considerations
  4. Potential tort liability

The panel will review these and other challenging issues:

  • Staying ahead of the curve through a timely introduction to the law governing an emerging industry
  • Exposure to different approaches taken in other municipalities
  • Identification of the approaches that have generated unwanted litigation
