Significant regulatory and enforcement changes to fair lending laws are underway as the Bureau of Consumer Financial Protection (CFPB) assumes responsibility for promulgating new regulations for many of the fair lending laws and concurrent enforcement authority with existing regulatory agencies.

The National Community Reinvestment Coalition recently filed 22 fair lending complaints with HUD’s Office of Fair Housing & Equal Opportunity challenging lending requirements of many FHA lenders. In December, DOJ reached a $2 million settlement with PrimeLending signaling vigorous enforcement action.

Legal advisors to lenders with fair lending obligations must understand the impending regulatory developments and enforcement trends to effectively counsel their clients on potential changes to their fair lending programs.
