Description

Running afoul of export control and economic sanctions laws and regulations is far too easy. The Office of Foreign Assets Control (OFAC) fined oil and gas company National Oilwell Varco Inc. and two Canadian subsidiaries $25 million for sanctions and export control violations. The OFAC settlement stemmed from violations of the Cuban Assets Control Regulations, the Iranian Transactions and Sanctions Regulations, and the Sudanese Sanctions Regulations.

Even though most of the sales to Iran, Cuba and Sudan took place outside the United States, OFAC initiated the enforcement action because OFAC found that the U.S. executives “willfully blinded” themselves and approved exports from the United States that were ultimately destined for Iran.

Violations of export control and economic sanctions laws and regulations, even inadvertently, can result in stiff penalties and denial of export privileges, among other things. It is important for counsel to energy companies to understand the export controls and economic sanctions in place to avoid any unintentional export violations.
