Description

The demands on Medicaid continue to increase as more and more of the population lives longer. Criteria to determine level of care for Medicaid reimbursement or participation in long-term supportive services through a Medicaid waiver varies widely from state to state.

Medicaid transfer of asset rules are key in estate planning. Counsel should explore self-settled trusts as an option in estate planning and consider estate recovery rules.

Veterans may be eligible for Special Monthly Pension benefits. Practitioners must understand Medicaid eligibility requirements to avoid causing clients to lose potential benefits. Under the VA asset limitation test, giving away assets can create a long penalty period of ineligibility for Medicaid benefits.
