This CLE webinar will guide trademark counsel on recent developments from the latest Internet Corporation for Assigned Names and Numbers (ICANN) meeting. The panel will also discuss the current review of rights protection mechanisms, including the Uniform Domain Name Resolution Policy (UDRP), Sunrise and Claims Services, and the opportunities and risks presented by the various rights protection mechanisms (RPMs). The panel will discuss recent cases as well as how the U.S.'s ACPA fits into the equation.


ICANN has a set of RPMs intended to assist brand owners in protecting consumers from confusion caused by the abuse of trademark rights in domain names. The RPM Working Group (WG) continues to review the RPMs in all gTLDs, including legacy and new gTLDs.

Trademark and domain name owners have several options to consider when seeking to protect domain names, including the Uniform Rapid Suspension (URS), Sunrise registrations, Claims Service, the Trademark Post-Delegation Dispute Resolution Procedure (PDDRP), and the UDRP. Also available to those with access to the U.S. courts is the ACPA. Each has benefits and limitations.

Trademark owners and their counsel should remain vigilant, understanding the opportunities and risks of different RPMs and legislation, how to participate in the new gTLD sunrise periods, and how to defend their rights and be able to make the most strategic decision when pursuing infringing domain names.
