Description

Demonstrative evidence, a visual method of describing and explaining concepts that are difficult or impossible to put into words, is a powerful tool in personal injury litigation due to its persuasive and compelling effect on the jury. Rapidly evolving technology has armed personal injury counsel with new and cutting-edge methods for presenting demonstrative evidence. By incorporating iPads, mobile apps, 3D medical illustrations and other technological tools into their evidence presentation strategies, personal injury counsel can enhance the effectiveness of their demonstrative exhibits and increase their likelihood of success.

The admissibility of demonstrative evidence is a hotly contested issue in many personal injury cases. Counsel must be prepared to argue for or against the relevancy, authenticity and substantial similarity of demonstrative exhibits, and should use pretrial conferences, motions in limine, and stipulations to obtain pretrial rulings on their admissibility.
