Description

The federal courts are replete these days with privacy-related litigation, ranging from TCPA and FCRA cases to data breach and other forms of data misuse litigation.

Whether it’s congressional hearings, new cross-border data sharing legislation, or the disclosure of a significant cyber breach, nearly every day brings with it another data privacy or cybersecurity headline. And this widespread interest in protecting sensitive information leads to more robust regulation in the form of lawsuits brought by an aggressive plaintiff’s bar; U.S. regulators seeking to enforce a variety of privacy, data protection, and information security standards; and international regulators applying standards that are increasingly relevant to U.S. businesses.

Because of this, counsel must understand the recent developments in privacy litigation, including the privacy and security concerns associated with cloud computing and social media, and how the courts are handling the cases. Also, attorneys must understand how these issues may become liabilities for their clients, and how to respond to any privacy violation claims.
