This CLE webinar will discuss the full spectrum of privacy-related cases and how the courts are handling such matters in light of increased concerns about the proper scope and use of the massive amounts of data collected on individuals every day by corporate America. Our speakers will also discuss the common tactics in such cases and provide an outlook for future litigation.

The federal courts are replete these days with privacy-related litigation, ranging from TCPA and FCRA cases to data breach and other forms of data misuse litigation.

Whether it’s congressional hearings, new cross-border data sharing legislation, or the disclosure of a significant cyber breach, nearly every day brings with it another data privacy or cybersecurity headline. And this widespread interest in protecting sensitive information leads to more robust regulation in the form of lawsuits brought by an aggressive plaintiff’s bar; U.S. regulators seeking to enforce a variety of privacy, data protection, and information security standards; and international regulators applying standards that are increasingly relevant to U.S. businesses.

Because of this, counsel must understand the recent developments in privacy litigation, including the privacy and security concerns associated with cloud computing and social media, and how the courts are handling the cases. Also, attorneys must understand how these issues may become liabilities for their clients, and how to respond to any privacy violation claims.

Listen as our distinguished panel discusses recent trends in privacy and cybersecurity litigation, and prepares attorneys for how to best advise clients in preventing and responding to privacy violation claims.

  1. Discussion of recent trends in privacy breach litigation and FTC enforcement
  2. Impact of cloud computing on common privacy issues
  3. Claims arising out of social media and internet data collection
  4. Best practices for litigators in responding to privacy violation claims

The panel will review these and other relevant topics:

  • What are the recent trends in privacy and cybersecurity litigation?
  • How can counsel best respond to privacy violation claims and prepare for litigation?
