Studies suggest that jurors retain only 20% of what they hear, and the use of multi-media presentations can help. Strategies and preparation involving technology in cross-exam include using social media sites, live web streaming, and video depositions.

Applying human psychology in cross can also be effective, such as invading personal space, leveraging the witness’ ego, and asking loaded questions. Understanding juror perceptions of cross-exam is critical. Counsel must carefully balance controlling the cross-examination and appeasing the jury.
