This CLE webinar will prepare insurance coverage practitioners to handle difficult issues that arise in product-related claims under standard-form CGL policies. The panel will address complex coverage issues relating to property damage, occurrence, impaired property, incorporation, rip and tear, and economic loss. The panel will discuss the perspectives of both policyholders and insurance carriers.

Description

For companies facing costly product-related claims and litigation, insurance coverage is essential to mitigating losses. Difficult coverage questions arise in product-related claims under standard-form CGL policies, including whether there is “bodily injury” or “property damage” or an “occurrence,” and whether the “impaired property” exclusion applies.

Coverage is fact specific and dependent on policy language. Counsel for policyholders and insurers must prepare with knowledge and understanding of the scope of these policies, coverage triggers, property damage, occurrences and other key coverage issues to represent clients in product-related claims and litigation.

Listen as our panel of insurance practitioners walks you through the key coverage issues in products-related claims as they relate to policyholders and insurance carriers. The panel will analyze the complex coverage issues relating to property damage, occurrence, impaired property, incorporation, rip and tear, and economic loss.

Outline

  1. Property damage
  2. Occurrence
  3. Impaired property
  4. Incorporation
  5. Rip and tear
  6. Economic loss

Benefits

The panel will review these and other key issues:

  • Is a physical change or alteration to tangible property required before it will qualify as the physical injury variant of “property damage” as used in a standard CGL policy?
  • Does the incorporation of a defective component into a larger system constitute “property damage” under a CGL policy?
  • Does the phrase “property damage caused by an occurrence” require a showing of unforeseeable physical damage to property other than what the economic loss doctrine would deem to be the insured’s product?
