This CLE webinar will provide guidance to healthcare counsel for providers and companies using cloud computing services. The panel will examine the legal considerations and compliance issues under federal and state laws. The panel will offer approaches for healthcare providers and counsel to mitigate privacy and security risks and ensure regulatory compliance.

Description

The healthcare industry is increasingly turning to the cloud to host patient engagement tools, for big data analysis, telemedicine services, digitalization of medical records and medical monitoring device output. Hospitals, physicians and others in the industry using cloud computing must address myriad legal risks.

Healthcare providers and business associates must consider privacy and security requirements under HIPAA, HITECH and state laws and understand how U.S. privacy laws will be enforced in international jurisdictions. Allocating liability for a data breach between the provider and cloud computing vendor is also a challenge.

Counsel to hospitals, physicians and healthcare companies must carefully negotiate underlying services agreements and business associate agreements with cloud computing vendors that include clear warranty, indemnity and data disclosure provisions. Providers should also obtain sufficient cybersecurity insurance to mitigate loss in the event of data breach.

Listen as our authoritative panel of healthcare attorneys examines the legal considerations under HIPAA, HITECH and other federal and state laws that impact healthcare providers for counsel making decisions about cloud computing.

Outline

  1. Legal considerations under HIPAA, HITECH and state privacy laws
  2. Negotiating business associate agreements with cloud computing vendors
    1. Risk allocation/shifting provisions
    2. Liability for data breach
  3. Challenges of international jurisdiction when patient information is stored outside of the U.S.

Benefits

The panel will review these and other key issues:

  • What are the privacy and security risks of cloud computing that healthcare organizations should consider?

  • What measures should healthcare providers take to ensure compliance with HIPAA and state law requirements in the cloud?
  • What risk allocation and mitigation provisions should counsel to hospitals and physicians include in business associate agreements with vendors to help mitigate liability for data breach?
