This CLE webinar will guide healthcare counsel on new and developing issues, including data privacy and security, emergency treatment, and reproductive rights, in state and federal legal requirements related to reproductive services after the Dobbs decision.

Description

Since the Supreme Court's decision in Dobbs v. Jackson Women's Health Organization (U.S. 2022), several states have enacted or are enacting legislation limiting or preventing access to reproductive healthcare, and the interaction of these laws with other requirements related to healthcare is in many cases, unclear and confusing.

For example, HHS Office for Civil Rights issued new guidance that clarifies but does not change HIPAA's Privacy Rule requirements and their application to the use and disclosure related to reproductive healthcare information that HIPAA-covered entities and their business associates hold. Further, healthcare providers should also remember that other laws, such as EMTALA and state laws, are in play and consider the interplay with these laws as they evaluate current policies and procedures in light of recent developments.
