This CLE course will provide counsel for construction contractors and developers with an analysis of evolving coverage issues in builder’s risk insurance and recent case law developments. The panel will outline best practices for counsel to structure coverage and resolve coverage disputes that arise during construction.


Construction projects are always at risk for economic losses from unanticipated property damage and business interruption that result in unbudgeted and costly expenses needed to complete the project. Builder’s risk coverage is a key risk mitigation measure for building contractors and developers.

Builder’s risk coverage disputes involve the insurance rights, tort liability and contractual obligations of the owner, general contractor, subcontractors and design professionals. Counsel often must navigate the interplay between builder's risk policies and commercial property and CGL policies.

Coverage issues that counsel to builders and developers must consider include identification of named and additional insureds and the interests of subcontractors and equipment. Coverage disputes typically arise over the types of costs recoverable and the coverage exclusions and exceptions.
