This CLE webinar will provide guidance to healthcare counsel on the regulatory requirements for physician relationships with third parties under the Stark law, Anti-Kickback Statute (AKS), False Claims Act (FCA) and Fraud Enforcement and Recovery Act (FERA). The panel will discuss best practices for conducting an effective internal audit of physician relationships and responding to the audit results, as well as offer guidance to minimize liability for noncompliant physician relationships.

Description

Physician contracts must be carefully structured and monitored to ensure compliance with federal law. Physician relationships should also be audited and reviewed to ensure they will withstand heightened regulatory scrutiny and to avoid enhanced penalties and liabilities.

Typical physician relationships that should be reviewed include space and equipment rentals; employment relationships; medical directorships; physician ownership in group practices, ambulatory surgery centers, and imaging centers; and physician compensation arrangements with medical device manufacturers.

Conducting audits of physician relationships is an important element to ensure compliance. It is critical for healthcare counsel and providers to understand the steps necessary to conduct an effective audit of physician relationships as well as respond to the results of those audits.
