Description

A judgment creditor may seek to collect from a judgment debtor’s assets even if the debtor has appealed the judgment. Counsel for the judgment debtor must take immediate steps to shield the debtor’s assets from a judgment creditor while the appeal unfolds.

Traditionally, the judgment debtor has to post a security to cover the judgment amount, plus interest and costs. Ever-increasing damages awards create greater financial hardships for judgment debtors. As a result, counsel must understand bonding options, alternatives to bonding, and how to obtain a stay pending appeal.
