Settlements reached in wage and hour cases under the Fair Labor Standards Act (FLSA) and state law have increased significantly in dollar amount over the past few years. The 10 largest class action wage and hour settlements in 2010 totaled $336.5 million.

Effective settlement strategies can minimize the time and expense of FLSA litigation. Employment counsel should proactively plan for these and other key issues: whether settlement is appropriate, when to begin settlement discussions, and how taxes will impact the settlement payments.
