Description
The question of inventorship is often difficult to answer. Scientists typically include everyone involved with an invention on the disclosure form. Patent counsel must determine which person or persons is actually an inventor and how each contributed.
Errors may be discovered and changes may need to be made after the patent application is filed. Corrections can be made while the application is still pending or after the patent has been granted, so long as the need to correct the inventors occurred without deceptive intent.
Learning to properly conduct an inventorship determination is critical for patent counsel to avoid complications that result from an incorrect or incomplete identification and determination.
