Federal and state regulators are focusing their attention on vapor intrusion contamination. Property owners and any business found to contribute to groundwater or soil contamination should take heed. Even contaminated sites previously closed by the government are not exempt from renewed scrutiny.
The EPA and states lack a consistent approach on vapor intrusion risk management. ASTM International released standard E2600-08, addressing the assessment of vapor intrusion into structures involved in commercial real estate transactions. However, absent uniform standards, uncertainties remain.
Property owners and their counsel must understand the new ASTM standard and its impact — and how to manage the risks, defend against potential liabilities, and approach potential litigation stemming from vapor intrusion in an uncertain regulatory environment.

He handles federal and state environmental litigation, including cost recovery cases, citizen lawsuits, natural resource damages and enforcement actions.
Lawrence Schnapf, Schulte Roth & Zabel, New York. He focuses on Brownfield development, environmental issues in transactions, and regulatory compliance. He served as co-chair on the ASTM Vapor Intrusion Task Force, Legal Subcommittee. He also handles environmental litigation matters.
Cynthia J. Bishop, Partner, Gardere, Dallas. She focuses on environmental litigation, regulatory counseling, due diligence, and government actions. She defends clients in lawsuits involving vapor intrusion, groundwater, and soil contamination. She has litigated federal CERCLA contribution and cost recovery actions as well as state statutory and common law claims involving property damage and personal injury allegedly caused by contamination.
