Concerns over the effects of climate change have risen dramatically in the past few years. Government and businesses are emphasizing environmentally protective approaches, including building techniques designed to reduce environmental impacts, also called green building.
The federal government established green construction guidelines in 1998; cities such as New York, Washington, Atlanta and Seattle have enacted green building requirements for public construction projects. Several states offer tax incentives to developers that follow specific green building methods.
Green building will continue to increase significantly. These new business opportunities for builders and developers bring new legal issues, including complying with regulatory and permitting requirements and negotiating construction contracts.

The panel included:
Jeffrey D. Masters, Partner, Cox Castle Nicholson, Los Angeles. He is Co-Chair of the firm's Development Risk Management Practice Group. He represents developers and homebuilders in real estate litigation. He is a frequent lecturer for real estate industry groups.
Don Neff, President, La Jolla Pacific, Ltd., Irvine, Calif. He is a construction quality expert with more than 25 years of experience in the real estate industry, covering all aspects of planning, development, construction and management.
Cherie S. Raidy, Partner, Foley & Lardner, Los Angeles. She is a member of the Real Estate Team, focusing on real property projects. She lectures on various real estate topics and recently published an article on the legal requirements for going green.
