Litigation related to global climate change is increasing. Lawsuits have been filed across the country, in the District of Columbia, New York, North Carolina, Minnesota, Mississippi, California and Washington—so far; more suits are expected.
Just weeks ago, the president signed into law an energy bill aimed at reducing greenhouse gases.
As companies face potential litigation and EPA regulation, they are turning to their insurers to address the potential liability related to climate change. There is much uncertainty and many questions that insurers and their policyholders should consider now.
Listen as our authoritative panel examines what claims are being filed, insurance coverage issues facing companies and insurers, and how companies and insurers can mitigate risk and liability.
The panel included:
John D. Green, Partner, Farella Braun + Martel, San Francisco. He represents insureds seeking insurance coverage under general liability and D&O policies for a variety of lawsuits, including commercial torts, antitrust, toxic torts and environmental litigation. His practice includes both negotiation with carriers to obtain policy benefits and litigation of insurance coverage and bad faith actions.
John N. Ellison, Partner, Reed Smith, Philadelphia. His practice concentrates in the insurance coverage area exclusively on behalf of policyholders, including coverage for environmental liabilities, asbestos-related claims and other toxic torts. He handles claims under directors and officers policies, fidelity bonds, first-party property policies and other liability insurance products, and counsels clients on insurance-related issues.
Theodore A. Howard, Partner, Wiley Rein, Washington, D.C. He counsels and represents domestic and international insurers and reinsurers in insurance coverage disputes and related litigation and has considerable experience in other complex civil litigation. He represents clients in coverage and reinsurance disputes involving asbestos, dioxin, hazardous waste and noise, chemical exposure, and reinsurance and agent-broker controversies.
The panel reviewed these and other key questions:
- What are the underlying causes of action for lawsuits on climate change liability facing companies now?
- Can policyholders establish coverage using a qualified pollution exclusion?
- Do climate change/global warming claims involve an occurrence? Does the lack of an occurrence preclude coverage?
