The Centers for Medicare and Medicaid Services (CMS) released the FY 2009 Inpatient Prospective Payment System (IPPS) Final Rule on July 31, which makes several important changes to the Stark Law regulations on physician self-referral.
The new revisions, effective October 1, finalize earlier proposals related to the “stand in the shoes” provisions and period of disallowance, among others. The new changes will bring more transparency to referral activity and physician financial relationships.
Listen as our panel of health law attorneys explains the key Stark Law changes addressed in the 2009 IPPS Final Rule and offers best practices for transitioning to the final rules.
The panel included:
Paul F. Danello, Of Counsel, Squire Sanders & Dempsey, Washington, D.C. He focuses on government regulatory matters affecting the healthcare industry. He was a member of an elite team of lawyers that provided guidance to OIG on the federal fraud and abuse laws.
Donald H. Romano, Director, Division of Technical Payment Policy, Center for Medicare Management, Center for Medicare and Medicaid Services (CMS), Baltimore. He is Director of the Division of Technical Payment Policy, Center for Medicare Management within CMS. He previously handled litigation, policy and integrity issues related to the Medicare program.
Ann DesRuisseaux, Assistant General Counsel, DaVita, Inc., El Segundo, Calif. She previously served as Senior Compliance Counsel and Acting Chief Compliance Officer for Novation, LLC, Assistant General Counsel with Triad Hospitals, and a private practice healthcare attorney.
The panel reviewed these and other key questions:
- How is physician self-referral impacted by the 2009 IPPS Final Rule?
- What are the practical consequences of the finalized "stand in the shoes" provisions?
- What do healthcare providers need to do now to ensure compliance with the new rules?
