Same-Sex Relationships and Family Law Issues

Navigating the Complexities of Marriage Portability, Asset Division, Support and Custody

Recording of a 90-minute CLE webinar/teleconference with Q&A

Conducted on Thursday, April 5, 2012
Recorded event now available

This CLE webinar will prepare family law counsel to manage same-sex couple issues such as the effect of non-uniform state laws, portability and dissolution of marriage, property division, support, agreements during relationships, separation agreements, ADR, and how to creatively leverage existing laws.

Description

Same-sex couples are confronted with many legal uncertainties due to the varying degrees of protection afforded them by federal and state law.

Family law counsel must advise clients on difficult issues involving the effect of non-uniform state laws regarding gay marriage and domestic partnerships, the portability and dissolution of marriage, property division, spousal support, and child support.

Counsel must also handle agreements during the relationship and separation agreements as a substitute to traditional divorce litigation. Custody, in the context of “second parent adoption” and reproductive assistance technologies, and resolution of custody between the parties are other key areas of concern.

Listen as our authoritative panel of family law practitioners examines approaches to assist same-sex clients in drafting key documents, creatively applying existing law, and addressing custodial and dissolution of relationship issues in an ever-changing legal landscape.

Outline

  1. Portability of marriage
  2. Agreements entered by parties during the relationship
  3. Separation agreements
  4. Property division
  5. Adoption issues
  6. Custodial issues
  7. Support of former partner and support of children
  8. Negotiating and drafting considerations

Benefits

The panel will review these and other key questions:

  • How can counsel creatively apply existing laws to same-sex issues in family law?
  • What best practices should counsel consider in handling custody issues in the context of “second parent adoption” and reproductive assistance technologies, and disputes as to which parent will receive custody in the event of dissolution?
  • What approaches should practitioners consider in drafting agreements during relationships and separation agreements as a substitute to traditional divorce actions?

Customer Reviews

I enjoyed the breadth of information provided in the seminar as well as the comparison of various state's approaches to same-sex relationships and family law issues.

Michael Griffin

TSLO

This webinar inspired us to consider how our own state's laws might be used to get custody and child support issues before the court, as well as creating a legal parentage prior to a break-up.

It seemed the presenters worked hard to coordinate their presentations so there was little overlap making the best use of the time allotted. Thanks — terrific job by all.
