This CLE webinar will provide best practices to family law attorneys for negotiating, drafting and litigating the validity of premarital, postnuptial and cohabitation agreements with special consideration of the unique issues involved in representing the interests of either financially stronger or weaker parties.
Description
Overcoming the complexities to craft prenuptial and postnuptial agreement provisions that will withstand judicial scrutiny is critical. Representing either the financially stronger or the weaker party has unique ramifications on strategies used for drafting and negotiating agreements.
Identifying and analyzing factors and legal implications to determine the agreement best suited for a client’s needs is a critical first step. Strategies to enhance the validity of the agreement and overcome obstacles due to a disparity in the parties' resources are key.
Litigation planning to either attack or defend a challenge to the validity of a premarital agreement is also important. Counsel must focus on the content of the agreement and the process leading to executing the agreement.
