Description
Medicaid pays almost half the cost of all nursing homes and other long-term care expenses. Through Medicaid estate recovery programs, states can file claims against the estates of Medicaid recipients who received Medicaid assistance for long-term care and medical expenses.
As Medicaid seeks reimbursement for the funds it paid, states may overreach and improperly place liens on property. Counsel must navigate Medicaid recovery programs and procedures to protect client interests.
