The real impact of the Supreme Court's decisions in Kelo, Lingle and San Remo -- and whether they broke any new ground, clarified or just confused matters -- has been the subject of heated public debate.
The Court's holdings, particularly Kelo's ruling that economic development constitutes a public use under the 5th Amendment's Takings Clause, triggered dramatic reaction -- many call it an over-reaction.
Nonetheless, both Congress and state legislatures have introduced measures to limit government use of its eminent domain power.
Listen as our panel of local government and property law specialists discuss the after-effects of Kelo, Lingle and San Remo, and offer guidance on moving forward with utilizing eminent domain to revitalize local economies.
Our panel includes:
Michael M. Berger, Partner, Manatt, Phelps & Phillips, Los Angeles, is Co-Chair of the firm’s Appellate Practice Group. One of the top land use and condemnation lawyers in the U.S., he represents homeowners, landowners, and developers in complex litigation. He filed amicus briefs in Kelo, Lingle, and San Remo. He also handles planning, zoning, eminent domain, property insurance and environmental law matters.
Robert H. Freilich, Special Land Use Counsel, Paul, Hastings, Janofsky & Walker, Los Angeles, is at the forefront of real estate investment, master planned communities, zoning, entitlement, public/private joint development, land use and taking litigation. He has represented real estate investment clients in numerous jurisdictions and has handled over 150 land use cases. Dr. Freilich is the author of the leading casebook in the field, Cases and Materials on Land Use.
Dwight H. Merriam, Partner, Robinson & Cole, Hartford, represents developers, local governments, landowners, and advocacy groups in land development and conservation issues. He has published numerous professional articles on land use law, co-edited the new book Eminent Domain Use and Abuse: Kelo in Context, co-authored The Takings Issue, and authored The Complete Guide to Zoning.
Edward J. Sullivan (Moderator), Owner, Garvey Schubert Barer, Portland, OR, specializes in land use and condemnation and municipal law. He is a member of IMLA's International and Land Development, Planning and Zoning Committees.
They address these and other key questions:
- What are the limits on local governments in exercising its eminent domain power?
- What constitutes public use for eminent domain purposes where private development is involved?
- After Lingle, what does the future hold for regulatory takings challenges?
- When might a regulation be so arbitrary and irrational as to violate due process?
- Will the Court reconsider the Williamson County rule that takings claims should be heard in state court?
Plus, you’ll have an opportunity to get answers to your specific questions during the interactive Q&A session following the speaker presentations.
