Witness cross-examination can be a deciding factor in the outcome of a case. Effective techniques for cross depend on whether the cross is corroborative or destructive, whether the witness is an expert or layperson, and the litigation stage when the cross occurs.
Using technology in cross should be considered, particularly since studies suggest that jurors retain only 20% of what they hear. Strategic preparation involving technology in cross-exam can make use of social media websites, live web streaming, and video depositions.
Applying human psychology in cross—such as invading personal space, using the witness’s vanity, and asking loaded questions—can also be very effective. Understanding the jurors' perception of cross exam is just as vital. Counsel must carefully balance witness control with jury appeasement.
