The Class Action Fairness Act, signed by President Bush today, is viewed as the most significant class action legislation to date. The measure shifts most large multi-state class action lawsuits from state to federal courts, which have historically been less likely to award huge damage awards.
The bill's aim is to protect businesses from potentially abusive litigation and stop lawyers from forum shopping. But opponents claim it will be much harder for ordinary citizens to hold big companies accountable under the new rule.
