September 11. The Northeast Blackout. Hurricanes Katrina and Rita. These and other less dramatic events triggered overwhelming losses for businesses around the country.
For many companies, it was the first time they identified deficiencies and ambiguities in their insurance coverage. Business interruption insurance -- for the loss of income due to severe property damage -- is the source of much controversy and litigation.
Listen as our authoritative panelists brief you on the legal issues that have arisen from both catastrophic tragedies and the more mundane -- and more likely -- events that could nonetheless cause costly disruptions in business operations.
Barry S. Neuman, Of Counsel, Carter Ledyard & Milburn, Washington, DC (effective May 1, 2006), has practiced in complex commercial and environmental litigation for more than 30 years. He represents the plaintiff in HMSHost Corp. V. Zurich Am. Ins. Co. -- the only case in which a federal court has held that the "civil authority" provision provides coverage for business interruption losses sustained at airports around the country due to the Sept. 11 attacks.
Richard P. Lewis, Shareholder, Anderson Kill & Olick, New York, specializes in insurance recovery and international arbitration. He has extensive experience litigating a wide variety of first- and third-party insurance coverage issues. He co-chairs the Property Insurance Subcommittee of the ABA Section on Litigation, Insurance Coverage Committee.
Douglas K. Williams, Partner, Breazeale Sachse & Wilson, Baton Rouge, is a member of the firm’s executive committee and the practice section head of the Casualty Litigation Section. He practices in the areas of product liability, medical malpractice defense, mass torts/class actions, insurance defense, and interstate common carrier matters.
The panelists address such key questions as:
- What are insurers paying, and what they are trying to exclude?
- What are the most highly disputed areas between insurers and businesses filing claims for income interruptions?
- What legal and practical issues arise in valuing claims?
